With respect mate, that's your opinion. I get called to this kind of incident day in and day out and callers quite regularly form the opinion the offender is in drink but 95 per cent of the time they are as sober as a judge. If he is pissed then hopefully he gets caught. Unfortunately your opinion or your photographs mean nothing evidentially other than perhaps proving who was actually driving at the time of the incident.

If he is located at home and is drunk he will still be arrested.

What used to be called the hip flask defence can now no longer be used...I.e claiming to have drunk after the incident.

I got rear ended some 15+ years ago, the guy stopped, got out and swapped details, he stunk of alcohol so I called the police and gave them his details.

Unfortunately when the police arrived at his they confirmed he had been drinking but he said he'd started drinking when he got home to 'calm his nerves'. The police said they couldn't prove when he'd had a drink..........
 
Yeah, I hate drink drivers as one of my good friends got killed by a drink driver, if not on this occasion but hopefully on the next he will get caught

Si - what's the law now on making a citizens arrest if Birchy thought he was driving while intoxicated? Could Birchy have held on to him until the Police couold get there to do a roadside breath test? Where do our rights stop as citizens?
 
The only problem with that sometimes that's more hassle that's it worth, as being ex doorman and Essex police special

In what way? Problem is doormen and specials largely don't actually know what powers they have, or don't use them properly due to poor training or ignorance
 
Well it's not the training, it more on the confrontation if you don't want it. I'm a big guy so not a problem but some people might get hassle doing a arrest especially if there desperate ie very drunk in charge of a vehicle

Nature of the beast. Part and parcel I am afraid. If you were 100% sure he was drunk then you could drag him out of the car to detain him.
 
Could off, but at the time I thought calling the police was the best thing to do if he wants to do a bunk when he sees me calling them thats his misfortune when he gets caught on a DD charge (hopefully at some point)

True but I would personally grabbed hold of him to prevent him knocking a child over, perhaps over taking a picture.

I know its all split second stuff, but people generally are worried about putting hands on people due to our blame society.
